New Blog for Brides!

As you might have guessed by now...I have decided to retire this blog. Though I will still write the occasional post when I feel particularly passionate about something, I have decided instead to focus my blogging energy somewhere new. BookCraft Weddings is a new wedding blog I've created featuring  inspiration boards, beautiful treasuries of handcrafted wedding items, and the best of weddings from around the web. In addition to all that will be spotlights on some of my wedding decorations, and info on new items & exciting events at BookCraft.

Pinterest: Why they shouldn't change their terms

Recently I've been seeing this floating around on Pinterest, coming from a blog post on knoed.com about the Pinterest terms that are scaring many of its users away. Well, have no fear.

I, like the writer of the blog post (Kyle), am no lawyer. I'm just a humble Etsy business owner who has taken a couple "legal speak" classes here and there. But I would like to share with you my views on the Pinterest terms issue and I hope that you will take them into consideration as well when deciding what to do. This is kind of long, because, quite honestly,  I see a lot of reasons to not worry about it. But please read.

Kyle, says that most people are falling into one of three categories: "1) scared to use their account, or 2) delete their account completely, or 3) continue using it and think nothing bad will happen." But I’m actually more of a 4) continue using it while making sure to simply follow the rules.

The very first thing that is pointed out is the Terms of use state that: 

"You acknowledge and agree that you are solely responsible for all Member Content that you make available through the Site, Application and Services. Accordingly, you represent and warrant that: (i) you either are the sole and exclusive owner of all Member Content that you make available through the Site, Application and Services or you have all rights, licenses, consents and releases that are necessary to grant to Cold Brew Labs the rights in such Member Content, as contemplated under these Terms"

I'm actually surprised that this made it as one the "scary" things about Pinterest. This part can be boiled down to: "If you don't own it, don't post it, unless you have permission." Which is a totally understandable policy and completely right. Though, I can see how this can sound very scary. According the Pinterest's Terms of Use "'Member Content' means all Content that a Member posts, uploads, publishes, submits or transmits to be made available through the Site, Application or Services."

Which basically, as I interpret it, adds up to all new content. Content that you pin from another site to Pinterest is Member Content. Content that you repin should not, under this definition, be considered as "Member Content that you make available through the site..."

You should never post, publish, submit, or any other synonym of upload images or other content on any site that you don't own or have permission to post because nearly every site on the web has this same policy in their terms of use:

Google’s Terms of Service (under “Using our Services” Fourth Paragraph, First line) Note that Google’s Terms of Service apply to all websites owned by Google including Blogspot
 “Our Services display some content that is not Google’s. This content is the sole responsibility of the entity that makes it available.” Facebook’s Terms (under Section 2 Sharing Your Content and Information, first line)
“You own all of the content and information you post on Facebook” Yahoo! Services Terms (under Section 6 Member Conduct) Note that Yahoo! Services include all websites owned by Yahoo! Including Flicker
“You agree to not use the Yahoo! Services to: e. upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements)”

The list could go on forever…

So Pinterest isn’t doing anything different than any other social media site. And, it can be argued that any site that adds a "Pin it" button to their web pages is giving you permission to pin the images on those pages.

The second issue of concern was that Pinterest is able to “sell” anything we pin. There are two reasons why this policy does not concern me.

Reason 1

Pinterest has never, and has yet to say (as far as I could find) that they plan to sell anything we pin. That is not how Pinterest makes their money. In fact, right now it doesn’t really make any money. Under “Getting Started” Pinterest answer’s the how-do-they-make-money? question with this: 

“Right now, we are focused on growing Pinterest and making it more valuable. To fund these efforts, we have taken outside investment from entrepreneurs and venture capitalists. In the past, we’ve tested a few different approaches to making money such as affiliate links. We might also try adding advertisements, but we haven’t done this yet.
 Even though making money isn’t our top priority right now, it is a long term goal. After all, we want Pinterest to be here to stay!”

Now I understand if this isn’t proof enough for you so…

Reason 2

The entire section reads: 

“By making available any Member Content through the Site, Application or Services, you hereby grant to Cold Brew Labs a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, access, view, and otherwise exploit such Member Content only on, through or by means of the Site, Application or Services. Cold Brew Labs does not claim any ownership rights in any such Member Content and nothing in these Terms will be deemed to restrict any rights that you may have to use and exploit any such Member Content.”

This means that they can only sell through the Pinterest sit, so until I see a Pinterest Image Store I’m going to feel safe pinning the content that I own or have permission to use.

Ok, now the third reason is about the legal fees. It states that

“You agree to defend, indemnify, and hold Cold Brew Labs, its officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of the Site, Application, Services or Site Content, (ii) your Member Content, or (iii) your violation of these Terms.”

 It is important to note that this only applies if/when you upload an image or video that you do not own to Pinterest, the actual owner sees it and does not want it to be there, and they decide to sue Pinterest over it. This is the only way I can see Pinterest getting legal fees over content that you uploaded.

Now, I can think of some reasons as to why this scenario is unlikely to happen but first I should point out that, once again, most social media sites have this very same “Indemnify” policy in their terms.

Indemnify - to provide somebody with protection, especially financial protection, against possible loss, damage, or liability

Google’s Terms of Service (under “Business Uses of Our Services”)
“If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify Google and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.” Facebook’s Terms (under section 15 Disputes)
“If anyone brings a claim against us related to your actions, content or information on Facebook, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.” Yahoo! Services Terms (under Section 11 Indemnity)
“You agree to indemnify and hold Yahoo! and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit, modify or otherwise make available through the Yahoo! Services, your use of the Yahoo! Services, your connection to the Yahoo! Services, your violation of the TOS, or your violation of any rights of another.”

Now, I’m no lawyer, but I know quite a bit about copyright law, and I can think of a few reasons why it is unlikely that you will need to pay legal fees. I’m going to pick a part example that Kyle gave at the end of his blog (no offense Kyle, it is just faster than coming up with my own). The example goes:

1.     You pin a picture of a cat without permission.
2.     Pinterest sells it to ABC Marketing.
3.     ABC Marketing prints it on kitty litter boxes.
4.     Cat picture owner sees kitty litter box in store and calls lawyer.
5.     Lawyer calls Pinterest.
6.     Pinterest calls you.
7.     Bad things happen.

Ok my problem with number 1 – you broke the law by pinning that picture. So in all fairness you should be end up getting punished (but I doubt you will).

Number 2 – As we have said, Pinterest doesn’t make money at all really right now, so I doubt that it would sell your stolen image to ABC.

Number 4a – The lawyer would then ask if the owner had registered the image with the U.S. Copyright office. If they did not, the lawyer would say that they can’t help them because, though they technically own the image upon creation, the defendant is innocent until proven guilty and a U.S. copyright is the only way to prove in a court of law that the owner was indeed the owner.

Number 4b – The owner does have the U.S. Copyright in which case the lawyer would call ABC who would say that they can’t be touched (i.e. no money for the owner) and the lawyer will…

Number 5 – Contact Pinterest who, according to Pinterest’s Copyright agreement, will pending review of the complaint…

Number 6 – Notify you, the original submitter of the image that Pinterest is…

Number 7 – Removing image. That’s it.

The image owner will then sadly turn and walk away knowing that they just wasted a ton of money on a lawyer and got nothing in return. The only way for the owner to get money, and for Pinterest to lay its legal fees upon you, is if you file a counter-claim stating the you do own the image. Then the owner can notify you and Pinterest that they are seeking a court order to remove the image which will have legal and financial consequences for you.

But of course, that is only if it even gets that far. Like I said, it is unlikely the image would be sold, or that the original owner would want the image off the site, (or that you would claim a stolen image as your own). And if you follow the rules, and not upload new content that you don’t own or have permission to use, none of this will matter at all.

Yes, it sucks that some - most - didn't realize this before, but deleting your account, not using it, and/or demanding that Pinterest changes their policies, ones that every other website we use also has, is really taking it overboard. We can’t blame Pinterest, or their policies, for our mistake. We agreed that we read them when we signed up and if we didn’t read them and pinned illegally, well that is still our fault.

If you speed, get pulled over, and the officer asks you if you knew how fast you were going, do you think it is right for him to not write you a ticket if you answer “no.”?

So please guys, breathe easy, Pinterest is fun, it isn’t out to get you, it just needs to protect itself. 

And stop pinning without permission.

Dear Chris Brown Defenders.....

Why do we seem to think that the future should be filled with people who never say "no" or tell others they are wrong. Hate to break it to you, but not every thought in your head is an "opinion" and you still can be just plain wrong. Just like Chris Brown was just plain wrong to hit her. There is no room for opinion here. It is wrong. Period.

He was wrong, and he should be punished for it. But he was not. I don't care what a court said. A court also let a man out on parole for beating and raping someone i know as well as a couple other women. If you think that court was right, please, imagine being the women who got beaten & raped finding out that by simply violating his parole he can come back and kill you. Or just rape and beat you again, and get another couple years in jail for it.

I come from a place where I see crimes of all types, against males and females, being committed and the offenders getting completely disproportional sentences. Any major act of violence against any one should hold far greater ramifications then a year or two in jail with parole. Because when those people get out, I've noticed that they tend to get angrier and more violent.

We can't sit here and accept it. Nor can we even think to say that he should get a second chance. Because out there, right now, are thousands of women in the U.S. who have been the victims of abuse, who will continue to live in their abusive homes. Not because they feel trapped, not because they have no where else to go (though there are many cases when these are the reasons) more than not, a woman will stay with a man who hits here because the next day he comes back with an apology. He begs and even cries and she wants to give him a second chance. Surely it was just this one time, right? It was my fault anyways. I shouldn't have made him so mad.


Wrong.


A week, a month, sometimes it takes a whole year. But it always happens again.
This is a fact that my mother has drilled into my head since before I was old enough to even want to date. Because she had been there. Because she knows exactly what it's like, and what it leads to.
It is dangerous to give in to the first act of violence. Each time you forgive you become more submerged in the world of abuse. The apologies slowly change and so do the after thoughts.
I shouldn't have made him so mad.
I shouldn't have said that.
I shouldn't have opened my mouth.
I shouldn't have disobeyed him.


Slowly you lose your self esteem & your independence. You soon really and truly believe you deserved to be hit.

And in world where most women never even get to experience any conversation about the signs and cycle of abuse we do not need to be teaching girls to be that woman. Rihanna was smart enough to get out. But here we are taking her place in the cycle. Accepting his half hearted apology and assuming that it will never happen again. Rihanna just shouldn't have made him so mad. 


This is not matter for discussion. This is no matter for opinion. This was just wrong. Everything about it was wrong. And we should have been yelling from the very beginning that Chris would receive, at the very least, a few years in jail. We should have been using this at a platform to discuss how awful the current system is for domestic violence. We should be talking about how the penalties for expressing anger threw your fists on another human being should far greater than they are.

But we're not.

We're using it to discuss his next album.
We're using it to discuss is performances.
And we're using it to discuss how violence against others is ok, and not a big deal.

Stressing ~ My Mind Monday

So you may have noticed that I missed a few posts last week...

Let’s just say, the optimism I had on Monday for this year quickly depleted around Tuesday.

I have my days pretty filled up with things to do. There is rarely a moment that passes where something doesn't need to be done. Such is life, right? But then that whole "one thing goes wrong that takes you hours to fix putting you nearly a day behind" thing happens. Except this week, the "hours" got turned into "days" and you can guess it put me a lot more than a day behind. So some things had to be sacrificed, like my blog. Sorry, but I'm (hopefully) back now.

I don't want talk about what all happened for a few reasons (like this post just turning into an angry rant) but the whole episode got me thinking a lot about stress.

It's an evil thing.

It ruins days.

But seriously, think about that. It ruins days. Perfectly good days, ruined. Why? Because you’re stressed. Because one big thing, or several small things, or a combination of the big and small things have went very wrong. We tend to stop thinking here. And we really shouldn't. Now is when we need to pose another question: Why is everything going wrong?

When I remember the real answer to this question, it puts everything back into perspective for me.

So far this month I have had 5 orders. That is an order every other day. That is the best I've done since I started. Well ok, I had a similar spike in September, but I also had a mega slump in December. When I think back, I realize that the times in my life when I was the most stressed were when things were going the best, or were about to get really great.

God blesses us, and the devil tries to bring us down, and since he is really good at what he does, it usually works. We try to overcome him by ourselves, and fail, because we forget who we're fighting against. We see all the things going wrong, and forget who is causing them.

I have a vague memory of someone explaining this fact of life by having us visualize it sort of like a flowchart.

So being the nerdy girly I am, I decided to make it for you.

My Mind Monday ~ Tis A Happy New Year Indeed!

Ok. First things first.

Ok, next order of business.

Normally, I don't really care that much about New Years. I mean, its fun and all, but I'm a night person, i don't need a reason to stay up until 12:00pm. I do that everyday! ..er...night! And i never really saw the point in watching the ball drop on tv... I mean, I'm sure it is much cooler in person... I suppose... but on TV it's just... eh. And I never make New Years Resolutions, I usually just lecture my friends on their superficial weight loss goals. However... 

I can not even begin to express how excited I am for this new year!

I am super excited about everything going on with my store this year! I have so many exciting ideas that I can't wait to implement. So, I have set myself the goal of listing 1 new item every week day until I hit 100 items in my store. I'm really looking forward to sharing all my new ideas & creations with you guys!

Writing Wednesday ~ Envious

I was inspired, recently, by this blog, to start a series with in this series.

Though I will interject with a poem, or song, or different story when I feel it's appropriate,  every Writing Wednesday I will write a flash fiction piece, no more than 500 words, based around an emotion. unlike Donovich's posts I will not be going in any particular order, but rather, I'll be using a random generator to pick the emotion each week. Also, each story will be like a short episode, peering into the lives of the same set of characters, and all the stories will be told in chronological order.

Today's emotion is.... envious.

Lets call this...
Chapter 1

Ellen sighed as he walked away with her. “She's pretty...” she thought, sighing as she struggled to keep here halfhearted smile in place. “She’s nice, she's smart, she is actually rather perfect...” She turned back to the coffee she had just poured, wrapped her thin, self-manicured hands around the warm paper cup, and, hoping it would be cool enough to indulge in, lifted it to her lips. Breathing in the steam, she lowered it with a sigh and glanced at the tiny, white clock that sat just an inch below the dingy drop tile ceiling of the fellowship hall.

Church was scheduled to start in just five minutes so she made her way to the sanctuary, keeping her pace quick and eyes focused in the hopes that any of the prying women, or even any of the genuinely nice ones, would assume she had some important business for the service to attended to.  Futile she knew, partly because there were a few who, if they noticed her, would simply not be so considerate, and partly because she would need to deal with the same problem once she got to the sanctuary. Service was scheduled to start at 10:00am, but everyone knew, and took advantage of the fact, that it wouldn’t actually begin until 10:15 or 10:20. Twenty minutes, at least, of faking happy. It’s not that she was that sad about it, she just didn’t want to talk about it. She knew she wouldn’t be able to clear her head of it. Not until she sat and rationalized her thoughts.

When she got upstairs she headed for the bathroom. It was quiet, and empty. She leaned over the small sink as she looked in the mirror. Her skin looked pale, and her pink lip gloss, purple in the unflattering incandescent blue overhead lighting.

“It’s a good thing,” she thought. “It’s very good… I wanted to hate her. I wanted to find some flaw, something that would make her wrong for him. That was wrong. I should want him to be happy. I want him to be happy. She makes him happy. She is pretty, and intelligent, and sweet. She has his sense of humor, she has his taste in music, and she’s perfect for him... She is perfect for him.”

She quickly splashed some soap and cold water on her hands as another woman walked in with her preschool aged daughter. She began to wander to her usual seat in the sanctuary as she continued to recite those thoughts to herself, using all her power to push back the one thought that incessantly fought its way to the front of her mind.

“But so am I…”

Writing Wednesday ~ Silver Bells Parody

So I happened to recently move into one of those towns. The type where nearly every house is covered in 20 strands of lights. But hey.. it's pretty!

Actually it is really pretty. I want to show you all some of the beautiful displays around here but I'm guessing my neighbors really won't appreciate me taking pictures of their homes to post on the internet. 

So since I can't show you, I thought I would tell. In song, of course! This just sort of came to me when I was driving through town with my fiance one day. It is a parody of the beloved Christmas song "Silver Bells."

My Mind Monday... On Tuesday...

Two weeks with a set posting schedule before I break it... Yep, that sounds about right.

It has definitely been one of those  weekends. Actually it has been one of those weeks. I started out the week excitedly talking about how backing Christmas cookies & decorating on my twitter & Facebook. I ended the week having only made 1 batch of Christmas cookies & not even having the tree up! 

With me having about hundred & one things on my to-do list for my Etsy shop, my fiance having finals, and the other not so fun parts of life, all of the things we wanted to do this week got kicked to the curb for the things we had to do. Don't you hate it when that happens?

The funny thing is, I knew this would be a busy week.

I'M ONLY PARANOID BECAUSE EVERYONE IS OUT TO GET ME ~ Writing Wednesday

Here is a more light hearted story, that was written purely for fun. Today, however, I am not the author. This awesome short story was penned by a very good friend of mine, Daniel Donovich.

He is a fantastic writer. Literally, he writes fantasy. Though, he does not (and most certainly should not) classify his work genre fantasy. He always writes stories with true literary value, and does so very, very well. To get a better taste of his work please go check out his blog. 


The story he gave us today is a bit different than his usual writing style (& he will probably say that is quite the understatement), it is more of a creative non-fiction piece. But I find it very fun & entertaining to read, & I think you will to.

Writing Wednesdays ~ Thinking Alone

This story just came to me one day. I'm not really sure where it came from, but it came to me so I wrote it down. I'm also not sure why it's written from the point of view of a middle aged man even though I'm a college aged girl, oh well. Many people seem to like it, so I thought I would share it with you.

On that particular morning I wasn't doing much of anything, just sitting on the dusty tattered couch in our living room sipping my morning coffee. I say our, but in truth it was no longer ours, just mine. Rather ironic, considering I was against the odd looking thing in the first place. It was stark red, made of some expensive, supposedly fine material, which I suspected was no more than dollar store yarn, which was now breaking, fraying and allowing the small bit of polyester stuffing to stick out. It looked and felt like a poorly knit blanket draped over a metal bench, which was quite befitting of my life at that point.

Ah Christmas... A time to spend with family, friends, & God; thanking Him for giving us His Son & each other. 
A time when we become more conscious of those around us & begin to show a greater kindness in our actions. 


Right?

Bitter Cold Please Leave

Don't get me wrong, I love Christmas & I love snow. What I don't love, what I rather hate, is the time between fall & the first real snow. I'm not talking about those little frozen rain drops that stick to the grass but make everything else look wet & muddy, I mean real fluffy, sticky, and perfect for a snow ball fight snow.

Unfortunately we usually don't get that type of snow around here until January, if we're lucky. But at least we then get about 10 feet dumped on us over the course of 36 hours at some "unexpected' point in February.

 (That may be an exaggeration)
